Terms of Use
This document provides users with the Regulations regarding the terms and conditions of use of the site www.pieco.eu which serves as a contract or distance contract between SC MERTEX DESIGN SRL and the client and is considered accepted by the parties involved at the moment when the consultant of SC MERTEX DESIGN SRL confirms the order.
1.The Website pieco.eu
The website www.pieco.eu, hereinafter referred to as PIECO, is the property of SC MERTEX DESIGN SRL, registered at the Trade Registry under no. J40/6869/2016, VAT ID RO 36080310, contact phone 0749 208487 with correspondence address in Mogoșoaia, Ciobanului Street 59, RECON-EX 2 HALA A1 hereinafter referred to as SC MERTEX DESIGN SRL.
2.User consent.
The use of the site implies automatic acceptance of the terms and conditions described in this document.SC MERTEX DESIGN SRL has the right to modify these provisions without prior notice.
SC MERTEX DESIGN SRL guarantees the user limited access, for personal and non-commercial purposes on the site PIECO.EU and does not grant the right to download, reproduce or modify partially or entirely the site, to copy, sell, resell or exploit the site in any other way, for commercial purposes or contrary to the interests of SC MERTEX DESIGN SRL without its prior written consent.
3.Intellectual property and copyright of SC MERTEX DESIGN SRL over the information published on the website.
The content of the PIECO website: images, texts, graphics, symbols, web graphic elements, emails, scripts, programs, and other data – is the property of SC MERTEX DESIGN SRL and its suppliers and is subject to the Law for the protection of copyright (law no. 8/1996) and the laws regarding intellectual and industrial property. The use without the consent of SC MERTEX DESIGN SRL of any of the elements listed above is punishable under the legislation in vigoare.Se allows the use of the PIECO website only within the limits of this document.
The content of PIECO (product descriptions, technical specifications, images, symbols) is composed in collaboration with the representatives of the respective manufacturers in our country.For this reason, SC MERTEX DESIGN does not assume responsibility for the descriptions and specifications of the products displayed on the PIECO website, as these are provided to us by the representatives of each manufacturer/supplier, or by the importers approved by them. SC MERTEX DESIGN SRL and its partners reserve the right to modify the descriptions and specifications of the products without prior notice.
4. Products, services, and prices on the PIECO website
Products sold through PIECO are new, in the original packaging of the manufacturer, and are accompanied by a fiscal invoice at the time of delivery, in accordance with the applicable legislation.
Products and services are offered subject to the provisions of this document and within the limits of available stock.For this reason, SC MERTEX DESIGN SRL has the right not to fulfill a specific order if the respective product is no longer available in the current offer of the importer. SC MERTEX DESIGN SRL reserves the right to select its customers.
Despite our efforts to maintain an up-to-date website, a small number of products may have incorrect prices listed on the site, set erroneously by our IT application. In these conditions, the final price is always considered to be the one accepted by the customer according to discussions held with the sales consultants of SC MERTEX DESIGN SRL.
The prices presented on the PIECO website include VAT but do not include delivery costs, which are displayed separately, except for those cases where it is expressly stated on the site.The purchase price printed on the invoice will be the same as that established by the sales consultant of SC MERTEX DESIGN SRL at the time of confirming the order as a firm order, or, in the case of online payment orders, this price will be the one published on the website at the time of purchase.
5.DELIVERY DETAILS, PAYMENT METHODS, and RETURNS
The products ordered on our website will be delivered immediately, subject to stock availability. Payment for products ordered online on the website PIECO.EU in accordance with these "Terms and Conditions" can be made either by credit card - online, or by bank transfer - wire transfer or internet banking to the account you will find on the proforma invoice, or cash on delivery.
After placing and finalizing the order in the shopping cart, the interface of the site PIECO.EU will automatically send a confirmation of receipt of the order to the specified email address, with the mention that you will only be contacted if there are stock discrepancies, incomplete delivery address, or phone number.
The online order confirmation will not create any obligations of any kind for PIECO.EU.
This document "Terms and Conditions" serves as a contract between MERTEX DESIGN and the client and is considered accepted by the parties involved.
An order received with the status confirmed does not determine stock reservation.
Full advance payment of the pro forma invoice determines the definitive reservation of the order from stock and the delivery of the product according to the term displayed on the site PIECO.EU.
Payment methods.
After confirming the order and receiving the pro forma invoice via email, the customer can make the payment for the ordered products as follows:
- payment by bank transfer (wire transfer) or Internet banking to the MERTEX DESIGN account, in which case you can send us the proof of payment to contact@pieco.eu Delivery will be made only after the funds have been credited to the MERTEX DESIGN account SRL.Plata by wire transfer to the MERTEX DESIGN SRL account at GARANTI BANK – RO23UGBI0000872001309RON.
- online payment with a bank card – through the Stripe interface. In this case, the order will appear as paid as soon as you have completed the payment.
- cash on delivery payment, in cash upon delivery, to the agreed courier.
Any total or partial cancellation by the customer of an order must be communicated in writing via email to contact@pieco.eu.
Delivery of products.
For products marked with the status Fast Delivery, delivery will be made immediately based on the placement of the order by the customer. If the order was placed before 2:00 PM on a working day, the order will be dispatched to the customer on the same day. If the order was placed after 2:00 PM, delivery will take place on the next working day after the day of the order.
For products with the status Available for delivery in 15 days, delivery will be made within the specified timeframe.
Product delivery will be made anywhere in the country through the courier companies displayed on the website PIECO.EU : DPD Romania, and FAN, PTT, Dragon Star Curier or collaborators, with the price calculated on the website PIECO.EU.
Without delivery costs, products can only be delivered if they exceed a certain amount and only if this is expressly stated on the website PIECO.EU
Product delivery will be free in the following situations:
- For products that have expressly stated this.
- For orders that exceed a certain amount.
In case the customer is not found at the mentioned address, during the time frame agreed upon, our courier will return once more after managing to contact them.If the customer is not found at the mentioned address, within the time frame agreed upon, nor upon return, the order will be canceled and the product will be returned to the headquarters, and the customer will bear the costs of a new delivery, regardless of the value of the ordered products.
The receipt of the products represents the customer's acceptance that the products have arrived in good condition and correspond quantitatively and qualitatively to what was ordered. This is done at the moment of receiving the package.
Acceptance of the "Terms and Conditions" as well as the receipt of the order may together or separately constitute a sales/purchase contract according to the current Romanian legislation. The customer explicitly expresses their agreement upon signing the delivery document regarding the fact that they have received the products that are in accordance with the order and their needs.
MERTEX DESIGN SRL reserves the right to delay or cancel deliveries of ordered products if they cannot be fulfilled for reasons beyond the control of MERTEX DESIGN SRL, which include: fires, explosions, floods, epidemics, strikes, government actions, wars, acts of terrorism, protests, uprisings, civil disturbances, or other force majeure impediments according to the customs of Romanian law.
The maximum value of damages attributable to MERTEX DESIGN SRL that can be paid by MERTEX DESIGN SRL to any client in the event of non-delivery or improper delivery is the amount received by MERTEX DESIGN SRL from that client.
Product return.
To facilitate the return of an order, we have created the "Sample Order" option so that you can choose the product you like with full knowledge.
The product you order is cut to the dimensions you need, therefore it is customized for you.
You can return a product if it has manufacturing defects, but not before contacting us and informing us of the issue you are facing. Our technical department will analyze the problem and determine the appropriateness of the return, along with the replacement of the product.
The replacement request is accepted only within the first 14 calendar days from delivery of the product.
You should know that you will bear the shipping costs.
In case the product can no longer be replaced due to lack of stock, or for other reasons, you should know that you will receive your money back within 14 working days, calculated from the receipt of the returned product by the company.
Additionally, the transportation costs will be deducted from the amount paid, considering that the transportation service has been provided and must be paid to a third party.
The right to return purchased products.
Due to the fact that our products are customized for you and cut to the dimensions you desire, according to OG 130/2000 art 10 lit c, you cannot return the product.
Therefore, we recommend ordering a sample before ordering the required lengths.
6.GDPR
SC MERTEX DESIGN SRL guarantees the confidentiality of the personal data of all those who complete the above-mentioned form.According to Regulation (EU) 679/2016 (GDPR), you have the following rights: the right to be informed, the right of access, the right to rectification, the right to erasure, the right to restrict processing, the right to data portability, the right to object, and rights related to automated decision-making and profiling.
Without affecting your right to contact the supervisory authority at any time, please contact us in advance, and we promise to make every effort necessary to resolve any issue amicably.

- RIGHT TO BE INFORMED [art. 12-14 GDPR]
Description.The right to be informed refers to the operator's obligation to take all appropriate measures to provide the data subject with any information regarding the processing of personal data. The information may be communicated in writing or verbally, provided that the identity of the data subject is proven by other means.
Through the right to be informed, GDPR establishes the information that must be provided and when data subjects must be informed about the processing of their personal data. The main attribute of the data to be provided is transparency.
- THE RIGHT OF ACCESS [art. 15 GDPR]
Description. The right of access means that the data subject has the right to obtain from the operator a confirmation as to whether or not personal data concerning them is being processed.In such cases, the data subject must have access to the respective data and a series of information.
- RIGHT TO RECTIFICATION AND/OR COMPLETION OF DATA [art. 16 GDPR]
Description. The right to rectification of data refers to the fact that the data subject has the right to obtain from the controller, without undue delay, the updating of data concerning them, especially regarding inaccurate personal data. The right to completion of data refers to the situation where, considering the purposes for which the data were processed, the data subject wishes to obtain modifications to personal data that are incomplete, including by providing an additional statement.
- RIGHT TO ERASURE OF DATA [art.17 GDPR]
Description. The right to erasure of personal data ("the right to be forgotten") is based on the principle of ensuring that any individual has the freedom to manage their personal data as they wish, including the right to delete it, unless there is a compelling or special reason for continuing its processing and storage.
The obligation to delete personal data applies in cases where one of the following reasons is applicable:
the personal data is no longer necessary for the purposes for which it was collected or processed;
the data subject withdraws consent on which the processing is based, in accordance with Article 6(1)(a) or Article 9(2)(a) of the Regulation, and there is no other legal basis for the processing;
the data subject objects to the processing under Article 21(1) of the Regulation and there are no legitimate grounds which override the processing, or the data subject objects to the processing under Article 21(2) of the Regulation;
there are ambiguities regarding the legality of processing personal data;
personal data must be deleted to comply with a legal obligation that you have as the operator;
personal data belongs to children under the age of 16.
The situations in which the refusal to comply with a request for the deletion of personal data is permitted are provided as exceptional situations, namely, those in which processing is necessary for:
the exercise of the right to freedom of expression and information;
compliance with a legal obligation;
reasons of public interest in the field of public health (Article 9 paragraph 2 letters h) and i) and Article 9 paragraph 3 of the Regulation);
purposes of archiving in the public interest, scientific or historical research, or for statistical purposes (Article 89 paragraph 1 of the Regulation);
the establishment, exercise, or defense of a right in court.
- THE RIGHT TO RESTRICT PROCESSING [art. 18 GDPR]
Description. The right to restrict processing refers to the possibility granted to the data subject to limit the operator's ability to process certain personal data.
The data subject has the right to obtain from the operator the restriction of processing in the event that one of the following cases applies:
the accuracy of the data is contested, for a period that allows the operator to verify the accuracy of the data in question;
the processing is unlawful, and the data subject opposes the deletion of personal data, requesting instead the restriction of their use;
the operators no longer need the personal data for processing purposes, but the data subject requests them for a legal action;
the data subject has objected to the processing (art. 21 para. 1) for the period during which it is verified whether your legitimate rights as operators prevail over those of the data subject.
If the processing has been restricted, such personal data may, except for storage, be processed only with the consent of the data subject or for the establishment, exercise, or defense of a right in court. In the case of personal data that has been subject to restriction measures, it may continue to be stored without fulfilling any additional formalities.
In situations where the processing of restricted personal data is required, it may operate in compliance with the following conditions provided for situations that necessitate obtaining consent, as well as:
the processing being necessary for the establishment, exercise, or defense of a right in court;
the processing being necessary for the protection of the rights of another natural or legal person or for important public interest reasons of the Union or a member state;
in any other cases that would require the processing of the data in question, obtaining the consent of the data subject is necessary.
- RIGHT TO DATA PORTABILITY [art. 20 GDPR]
Description.The purpose of this right is to give the data subject more control over their personal data. The right to data portability allows them to obtain and reuse their personal data for their own purposes across various services. This right enables the easy movement, copying, or transfer of personal data from one IT environment to another, in a secure manner.
The right to data portability applies only when:
the data is processed by automated means;
the data subject has given consent for processing;
the processing is necessary to fulfill the conditions stipulated by a contract.
Data portability constitutes a right of the data subject to receive a subset of personal data processed by an operator regarding them and to store that data for personal use in the future. In this context, storage can be done on a private device or a private cloud system, without necessarily transferring the data to another operator.
From a technical perspective, [company name] has implemented the following mechanisms to provide data subjects with portable data:
direct transmission of the entire set of portable data (or multiple parts extracted from the overall dataset); [to be validated]
an automated tool that allows the retrieval of relevant data [to be validated].
The personal data included within the scope of this right are:
personal data concerning the data subject (telephone, interpersonal messaging system, VoIP recordings), excluding anonymous data or data that does not refer to the data subject;
data provided by the data subject: data actively and knowingly provided by the data subject – postal address, username, age, etc. or observed data provided by the data subject by virtue of using the service or device – a person's search history, traffic data, and location data.
- 7 RIGHT TO OBJECT [art. 21 GDPR]
Description.In certain situations expressly provided by the GDPR, the data subject has the right, for reasons related to their particular situation, to object to the processing. The situations when the data subject can object to the processing are when:
the processing of personal data for direct marketing purposes;
the processing of data for profiling purposes;
the processing of data by automated means;
the processing for scientific or historical purposes.
Exceptional situations that nullify the right to object of the data subjects arise when it can be demonstrated that there are compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the data subject.Other exceptional situations are motivated by the establishment, exercise, or defense of legal claims or in situations where processing is necessary for the fulfillment of a task in the public interest.
- THE RIGHT NOT TO BE SUBJECT TO A DECISION BASED SOLELY ON AUTOMATED PROCESSING, INCLUDING PROFILES CREATION [art. 22 GDPR]
Description. Individuals have the right not to be subject to a decision when it is based on automated processing and can produce a legal effect or a similarly significant effect on the individual.
To ensure compliance with this right, it will be identified whether any of the processing operations include an automated decision-making process and, of course, you must update the procedures to meet the GDPR requirements.
This right does not apply to all automated decisions. The right does not apply in cases where the decision:
is necessary for the conclusion or execution of a contract between you and a natural person;
is authorized by law (for example, for fraud prevention or tax evasion prevention);
is based on explicit consent (Article 9 paragraph 2 of the Regulation);
when a decision does not have a significant legal or similar effect on a person.
GDPR defines profiling as any form of automated processing intended to evaluate certain personal aspects of a person, in particular to analyze or predict: performance at work; economic situation; health status; personal preferences; reliability; behavior; location; movements.
In the processing of personal data for the purpose of creating a profile, SC MERTEX DESIGN SRL will ensure that there are adequate guarantees regarding the following aspects:
the processing is fair and transparent by providing meaningful information about the logic involved, as well as the significance and consequences considered;
uses appropriate mathematical or statistical procedures for profiling;
has implemented appropriate technical and organizational measures that allow you to rectify errors and minimize the risk of error;
ensures the security of personal data in a manner proportional to the risk to the interests and rights of the individual and prevents discriminatory effects.
7.PRIVACY POLICY
In accordance with the requirements of Law no. 677/2001 for the protection of individuals regarding
the processing of personal data and the free movement of such data,
as amended and supplemented, and Law no. 506/2004 regarding the processing of data with
personal character and the protection of privacy in the electronic communications sector,
MERTEX DESIGN SRL is obliged to manage safely and
only for the specified purposes, the personal data provided about the client, a
family member or another person delegated by the client.
MERTEX DESIGN SRL collects the following personal data from its customers:
#data necessary for invoicing / delivering orders, provided voluntarily, namely
first name, last name, billing / delivery address, phone number, and shared with courier companies.
#the email address required for customers to access their own account created on
PIECO.EU and to modify billing / shipping information;
#traffic data, necessary for generating reports for the continuous improvement of the services offered by MERTEX DESIGN SRL, automatically collected including IP (Internet Protocol), visit time, visit duration, the location from which the store is accessed, the operating system and browser used, processed by Google Analytics.
MERTEX DESIGN SRL does not collect the data necessary for processing payments by card, as these are collected directly by the payment processor.
According to Law no. 677/2001, MERTEX DESIGN SRL customers benefit from
the right of access, intervention on data, the right not to be subject to an individual decision
and the right to address the judiciary.
Additionally, the right to oppose the processing of personal data concerning them and to request their deletion*.
To exercise these rights, customers can submit a written request,
dated and signed, sent by mail to the correspondence address in Mogosoaia, Strada Ciobanului 59 RECON-EX 2 HALA A1 or by email to the address contact@pieco.eu. De likewise, customers are recognized the right to seek justice.
If any of the information provided by customers is inaccurate, they are requested to
inform us as soon as possible by email to contact@pieco.eu.
*Note: Any person has the right to object, for legitimate reasons, to
the processing of data concerning them. This right to object may be excluded for
certain processing provided by law (e.g.: processing carried out by the
financial and fiscal services, police, justice, social security).Therefore, this
mention cannot appear if the processing is mandatory; any
person also has the right to oppose, free of charge and without any
justification, the processing of their personal data.
8. PROMOTIONS AND CONTESTS
MERTEX DESIGN SRL establishes the rules for the promotions and contests
it organizes.
These rules are communicated to potential participants only through its own website.
Only orders that strictly comply with the rules displayed on the website benefit from these promotions.
Promotions apply only to orders registered by the company during the specified time period in the regulations and for which the promotion is valid, and only within the limits of available stock.
We do not guarantee the availability of promotional products in stock and we may suspend or cancel it at any time without prior notice.
9. PRODUCT WARRANTY
The warranty conditions are in accordance with Law 449/2003 and O.G. 21/1992.
All products purchased from the site PIECO.EU have a 2-year warranty for individuals. For products that do not fall into this warranty category, this will be specified on the product page.
The warranty period granted to legal entities is 6 months. The warranty does not apply to products purchased for professional purposes that involve intensive use (for example, but not limited to use in restaurants, bars, terraces, swimming pools, gyms, etc.) or for the purpose of reselling them to the public. In this case, the Seller is no longer responsible for any non-conformities that arise with the products in question.
This term starts from the moment the products are received by the customer,
the document that certifies this being the fiscal invoice.
In the case of any manufacturing defects, the buyer will be able to file
a complaint. Any complaint, accompanied by the fiscal invoice or receipt and
the warranty certificate, submitted by the buyer within the term, in accordance with the provisions of
the warranty certificate, should be sent to the email address contact@pieco.eu.
The warranty of MERTEX DESIGN SRL aims to repair a product at no additional cost
in case of non-compliance or in case of a
manufacturing defect.
The refund of the product's value is made only if the product
cannot be repaired or replaced. MERTEX DESIGN SRL offers a warranty for products used in a usual manner, under normal usage conditions and according to the maintenance/care instructions displayed on the site.
The maximum value of damages that can be paid by MERTEX DESIGN SRL to
any client in the event of non-delivery of a product or improper delivery is the value of the product received by MERTEX DESIGN SRL from this client,
minus transportation costs if applicable, considering that
it is carried out by a third-party company, which must be paid regardless of the choice
of the client.
10. REVIEWS AND COMMENTS MADE BY USERS ON THE PIECO.EU
Users accessing the PIECO.EUwebsite can comment on
the products offered, which may be published on the site after prior
approval.MERTEX DESIGN SRL reserves the right, but not the obligation, to
not publish on the site comments containing illegal, obscene, threatening, defamatory, false content, that in any way disturbs the private life of other individuals, infringes intellectual property rights, contains viruses, text representing mass emails or any other form of spam.
MERTEX DESIGN SRL will not bear any responsibility and cannot be
held liable for any damages caused by
such comments or electronic communications, as they are provided under the same
limitation of liability as the rest of the content on the site, according to the articles
in this document.In the case of sending information other than that related to the
purchase/sale process of certain products, it is considered that the user
grants MERTEX DESIGN SRL and its partners the non-exclusive, unlimited, free, irrevocable, and transferable right to use, reproduce,
modify, adapt, publish, translate, as well as the right to distribute it by any
media means anywhere.
The user guarantees that they have all rights to the content they
transmit by any means for publication on the site or not, so that, by using this content, it does not cause harm to any other person.
MERTEX DESIGN assumes no responsibility and cannot be held liable for any damages caused by the information provided in the comments section.
Due to their nature, this information may become outdated over time.
11. QUALITY OF HOSTING SERVICES, LINKS TO OTHER SITES, FUNCTIONAL ERRORS
The site PIECO.EU is hosted on the servers of a third-party company. MERTEX DESIGN SRL cannot be held responsible for any errors that occur on the site, regardless of the reasons for their occurrence, including modifications to the site, settings, or updates to programmed scripts.
MERTEX DESIGN SRL cannot be held responsible for errors that occur due to the use of certain browsers to visit the site PIECO.EU.
MERTEX DESIGN SRL is not responsible for the content, quality, or nature of the websites accessed through links from the site
the respective websites, full liability lies with the owners of the websites in
question.
12. SUBSCRIPTION AND UNSUBSCRIPTION TO THE NEWSLETTER
Subscription and unsubscription to the newsletter of the site PIECO.EU is
free and voluntary, and implies acceptance of the following terms of use.
The messages sent are not unsolicited and you can unsubscribe at any time by following
the instructions in the footer of each email.
The messages sent comply with the law of Electronic Commerce regarding commercial communication as stipulated by Romanian and international legislation.
The use of the newsletter is subject to the same liability limitations regarding content as authorized for the use of the site, under the conditions set forth in this document, and the privacy policy is described in detail in points 6 and 7 of the "Terms and Conditions".
PIECO.EU holds all rights to the content of the newsletter sent to subscribers under the same conditions as for the information published on the site, in accordance with the provisions of this document.
Subscribers to the newsletter PIECO.EU may forward these commercial communications
to other persons, at their own responsibility, and provided that they have not
altered either the structure or the content of the respective messages.
Individuals who have received commercial messages from the newsletter subscribers PIECO.EU are considered to have been informed in advance by the subscribers about the provisions of this article. In this context, PIECO.EU MERTEX DESIGN SRL cannot be held liable in any way for the actions of its subscribers.
MERTEX DESIGN SRL reserves the right to restrict access to the newsletter for any subscriber if MERTEX DESIGN SRL has any reason to believe that the respective subscriber does not comply with the provisions of this document.
13.Jurisdiction
Any dispute arising between clients and MERTEX DESIGN SRL.it will be resolved amicably. In the event that the parties have not managed to resolve the dispute amicably, it will be resolved by the competent courts.
14.Transfer of ownership rights
The transfer of ownership rights over the products ordered from the site www.pieco.eu occurs at the moment of concluding the distance contract, namely at the moment you receive a message from our operator confirming your order.
15.Applicable legislation
Law no. 365/2002 on electronic commerce; Government Ordinance no. 130/2000 on consumer protection in the conclusion and execution of distance contracts, republished with subsequent amendments and completions; Law no.677/2001 for the protection of individuals regarding the processing of personal data and the free movement of such data, as amended and supplemented; Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector.
